Illinois Drivers License Reinstatement

Illinois Drivers License Reinstatement can be a complex and confusing process for any client. This blog addresses the keys to a successful Illinois Secretary of State Driver's License Reinstatement Hearing. In order to succeed there must be preparation and consistency. An attorney and his client must prepare for license hearing as if they were going to trial. Therefore, a careful review of the DUI alcohol evaluation and supporting documentation must be done to avoid any discrepancies between the client's testimony and what the hearing officers read on the paperwork. I also make it a point to actually conduct one to two practice hearings with my clients to make sure they understand the questions they are going to be asked, and are able to provide the correct responses. The paperwork required by the Illinois Secretary of State must be complete. I advise my clients to have the following documents:  DUI Evaluation Report or Updated Evaluation (must be completed no more than 6 months before hearing) , Proof of completion of DUI Risk Education ( except high risk) , Illinois Treatment Verification, Individualized treatment plan, discharge summary, aftercare/continuing care plan, & continuing care status report. In addition to those documents, I also encourage my clients to have the dui evaluator / treatment provider, prepare a Treatment needs assessment waiver and a chronological alcohol / drug use history. Please remember, evaluations are valid for only 6 months and you may need to get an updated report or new uniform report. If you are taking medications, medical report forms must be completed by your doctor and submitted at the time of hearing. Finally, if classified as a high risk,  3 letters from family and friends regarding current drinking/drug  patterns (abstaining) , and 3 letters from members of a support group are required.
