Repeat and Felony DUI Penalties in Illinois
While every case is different and sentencing discretion is reserved for the judge, the following penalties generally apply to repeat and felony DUI offenders in the state of Illinois:
Second DUI conviction
- License revocation: a minimum of 5 years
- Jail/Prison: up to 1 year in jail for a misdemeanor; anywhere from 1-3 years in prison for a felony
- Fine: up to $2,500 for a misdemeanor; up to $25,000 for a felony
- If carrying a passenger under age 16: Subject to 6 months in jail and an additional mandatory minimum fine of $1,250
- Community Service: 240 hours
- BAIID or SCRAM participation: required if a DUI hardship license is granted
Third DUI Conviction - Class 2 Felony
- License revocation: a minimum of 10 years
- Jail/Prison: imprisonment from 3-7 years
- Fine: up to $25,000
- If carrying a passenger under age 16: 25 days of community service and mandatory fine of $25,000 in addition to criminal penalties
- BAIID or SCRAM participation: required if a DUI hardship license is granted
Fourth DUI Conviction
- License revocation: for life
- Jail/Prison: imprisonment from 3 to 30 years depending on the class
What is the BAIID and SCRAM Program?
Both the BAAID and SCRAM program involve monitoring drivers who qualify for a DUI hardship license as they drive to and from work or school. The BAIID attaches to your car and functions like a breathalyzer, requiring you to blow into the device before your car will start. If your blood alcohol content (BAC) is measured at more than .025, the BAIID will turn off your car and not allow it to start. The SCRAM device attaches to your leg at the ankle and must be in continuous contact with your skin. It too measures BAC, using the body's perspiration, transmitting BAC readings to a remote central monitoring location.
The cost for installing a BAIID is roughly $150, requiring an additional $100 monthly fee while you are enrolled in the program. The SCRAM device costs roughly $15 a day.
